Which articles of the Criminal Code concern drugs?
Two articles are applied most often. Article 309 of the Criminal Code establishes liability for the unlawful acquisition, production, possession or transportation of narcotic substances without intent to sell. Article 307 concerns trafficking, as well as production and possession with intent to sell, and is much stricter. Drug smuggling (Article 305) and unlawful actions with precursors (Article 311) are punished separately. The gravity of the charge depends directly on correct qualification.
What is the difference between possession and trafficking?
The key difference is the presence or absence of intent to sell. Simple possession for personal use is qualified under Article 309, while possession with intent to sell falls under Article 307. The investigation proves intent to sell through a set of indicators: a significant quantity, packaging into doses, scales and wrapping materials, correspondence or arrangements. The defense revolves around exactly this, because requalification from 307 to 309 substantially changes the outlook of the case.

What are a controlled purchase and entrapment?
A controlled purchase is a lawful way to document trafficking, with the buyer acting under law enforcement control. But the law and case law distinguish between a purchase and entrapment: if a person was induced to sell drugs they would not otherwise have sold, that is entrapment, prohibited by Article 271 of the CPC and by the case law of the European Court of Human Rights. Evidence obtained through entrapment may be declared inadmissible. The lawyer analyzes who initiated the deal, how many approaches were made and whether pressure was applied.
How to verify and challenge a drug examination?
The expert report determines the type of substance and its amount (significant, large, especially large), and the qualification and gravity depend on the amount.
