Possession or trafficking: why the distinction is decisive
- The difference between Article 309 and Article 307 of the Criminal Code lies in the presence of intent to sell.
- The gravity of the charge and the penalty depend directly on the qualification.
- Intent to sell is proven by a set of indicators, not by a single circumstance.
- Refuting intent to sell is the main path to requalification under a milder article.
- Attorney Kobets helps achieve the correct qualification.
In drug cases, the article under which the acts are qualified often decides the fate of the whole case. Attorney Oleksii Kobets, with more than 25 years of experience and a background in investigative bodies, explains how possession differs from trafficking and how to achieve the correct qualification.
Why does qualification decide everything in a drug case?
Almost everything depends on the article under which the acts are qualified: the gravity of the crime, the possible measure of restraint and the size of the penalty. Possession without intent to sell under Article 309 and trafficking or possession with intent to sell under Article 307 differ dramatically, to the point that one qualification may mean a milder measure while the other means pre-trial detention. That is why the fight for the correct qualification is often the essence of the defense in drug cases, not a secondary issue.
How does the investigation prove intent to sell?
There is usually no direct evidence of an intention to sell, so the investigation relies on indirect indicators: a significant amount of the substance, packaging into identical doses, scales and wrapping materials, large amounts of cash in small bills, correspondence or arrangements for transfer. None of these indicators alone proves intent to sell; what matters is their totality and persuasiveness.
Example. An amount exceeding a “single dose” is found on a person, and trafficking is alleged on that basis alone. The defense shows that the amount is explained by a one-time stock purchase for personal use, and there are no signs of preparation for sale.
Need defense in a criminal case?
What arguments refute intent to sell?
The defense proves that the substance was intended for personal consumption: it explains the origin of the amount and the packaging, presents evidence of the person’s dependence, the absence of sale arrangements, the absence of “clients” and money flows. It also checks whether the conclusion about intent to sell is the result of the investigation’s assumptions rather than evidence, and whether neutral everyday circumstances are being interpreted as “signs of trafficking”.
Example. The investigation treats the fact that a person has two phones as a sign of trafficking. The defense explains the perfectly ordinary reason, a work number and a personal one, and by itself this circumstance loses its evidentiary weight.
How to achieve requalification from Article 307 to 309?
Requalification is possible when the investigation has not proven intent to sell beyond reasonable doubt. The defense files the appropriate motions, draws the court’s attention to the lack of proof, and seeks the exclusion of unreliable evidence, including evidence obtained through entrapment. Moving from Article 307 to 309 substantially changes the gravity and the outlook of the case.
How can a lawyer help?
The lawyer analyzes all the indicators the prosecution relies on, refutes intent to sell, seeks requalification and a milder measure of restraint, and verifies the lawfulness of the evidence. His background in investigative bodies helps attorney Kobets anticipate the logic of the prosecution. Defense is provided at all stages in Kyiv and beyond.
Frequently asked questions
What matters most in distinguishing Articles 309 and 307?
The presence or absence of intent to sell. It determines under which article the acts are qualified.
Is a large amount enough to prove trafficking?
No. The amount alone does not prove intent to sell; a convincing set of indicators is required.
Is requalification possible in court?
Yes, if intent to sell is not convincingly proven, the court may requalify the acts under a milder article.
What does requalification give?
A much milder article and penalty, and often grounds for a milder measure of restraint as well.
