What is a notice of suspicion?
A notice of suspicion is a procedural document by which the investigator, with the prosecutor’s approval, or the prosecutor personally, officially informs a person that they are suspected of committing a specific criminal offense. It is from the moment of its service that a person acquires the status of a suspect and the full scope of rights under Article 42 of the CPC.
The content of the written notice is defined by Article 277 of the CPC: it must contain the person’s details, the specific act, its legal qualification and a brief statement of the factual circumstances. This is not a mere formality: this document shows what a person is suspected of and on what grounds, and therefore what the defense will build on.
When and how is a notice of suspicion served?
The service procedure is governed by Article 278 of the CPC. The written notice is served on the day it is drawn up or, if that is impossible, sent in the manner prescribed by law. A notice is served, in particular, upon detention, when a measure of restraint is chosen, or when there is sufficient evidence. It is important to check whether the procedure was followed: who drew up and approved the document, whether the act is correctly qualified, whether the rights were explained and a copy provided.
Example. The notice is served late in the evening, “in passing”, without fully explaining the rights, and the person is immediately asked to “briefly explain the situation”. In practice, notices of suspicion are often drawn up in haste: with an incomplete statement of circumstances, incorrect qualification, without proper approval or with violations of the service procedure. Such defects may indicate that the suspicion is unfounded.
Example. The act is qualified in the notice under a graver article than the factual circumstances allow, so as to later justify a stricter measure of restraint. Can a notice of suspicion be challenged?
Yes. Article 303 of the CPC allows challenging the validity of the suspicion before the investigating judge, but not immediately: the right arises after one month from the notification of suspicion of a criminal misdemeanor, or two months in the case of suspicion of a crime, and no later than the indictment being sent to court. Individual actions and decisions of the investigator and the prosecutor can also be challenged.
